Compete in the Rally

Maximum 50 competitors. Where entries exceed capacity, priority is given to returning competitors from previous editions.

Indemnity & Waiver — Terms and Conditions of Entry (IW-2026-1.0)

Read each clause and tick to accept. All ten clauses must be accepted for the entry to be valid. Your typed name, the date, your IP address and a timestamp are recorded as your electronic signature.

1. Acknowledgement of Risk

I acknowledge that motorsport is dangerous. Participation in the Mombasa TukTuk Rally 2026 and all associated activities — including scrutineering, reconnaissance, shakedown, liaison sections, special stages, service, parc fermé and ceremonies (together, "the Event") — carries inherent risks including collision, mechanical failure, road hazards and the actions of other persons, which may result in property damage, serious bodily injury or death.

2. Voluntary Assumption of Risk

I enter and take part in the Event entirely voluntarily and at my own risk. I have had the opportunity to inspect the route and venues during official reconnaissance and I accept the conditions of the roads, venues and facilities as I find them.

3. Release and Discharge

To the fullest extent permitted by the law of Kenya, I release and forever discharge the Tourism Week Secretariat, Crabmen EA, Listen Media Limited, the County Government of Mombasa, the Mombasa Tourism Council, the Clerk of the Course, stewards, officials, marshals, volunteers, sponsors, partners, landowners and their respective directors, officers, employees and agents (together, "the Released Parties") from all liability, claims, demands, actions and causes of action arising out of or connected with my participation in the Event, including those arising from the negligence of a Released Party, save only for liability that cannot be excluded by law.

4. Indemnity and Hold Harmless

I shall indemnify and hold harmless the Released Parties against all claims, damages, losses, costs and expenses (including legal costs on a full indemnity basis) brought by any third party arising out of my acts or omissions, my vehicle, or my breach of the Supplementary Regulations, the Event Operations Manual or the lawful instructions of Event officials.

5. Fitness and Medical Consent

I declare that I am medically and physically fit to compete, that I have disclosed all relevant medical conditions at registration, and that I am not under the influence of alcohol or impairing substances. I authorise the Chief Medical Officer and appointed medical personnel to administer any treatment, transport and hospitalisation judged necessary, and I accept responsibility for the costs of such treatment.

6. Compliance and Exclusion

I shall comply at all times with the Supplementary Regulations, official Bulletins, the Road Book and the instructions of Event officials, and I accept that the Clerk of the Course may refuse my start, stop my participation or exclude me from the Event, without refund or compensation, for any breach or on safety grounds.

7. Vehicle, Licences and Insurance

I warrant that the tuktuk entered is roadworthy and has passed scrutineering; that it is registered and carries third-party insurance valid for 24–27 September 2026; and that I and any named co-driver hold valid driving licences (Class B minimum or tuktuk equivalent) and a valid PSV licence. Insurance of the vehicle and its contents remains solely my responsibility.

8. Image and Media Rights

I grant the Organisers and their media partners a perpetual, royalty-free licence to record, use and publish my name, voice, image and the image of my vehicle in photographs, film and broadcast produced at the Event, for reporting and promotion of the Event and future editions.

9. Data Protection

I consent to the Organisers collecting and processing the personal data and documents submitted with this entry for the purposes of Event administration, safety, accreditation and results, in accordance with the Data Protection Act, 2019 (Kenya). Data is stored securely, is not sold, and identity documents are retained no longer than necessary for the Event and any resulting proceedings.

10. Governing Law, Severability and Capacity

This agreement is governed by the laws of Kenya and the courts of Kenya have exclusive jurisdiction. If any clause is held unenforceable, the remaining clauses continue in full force. I confirm that I am 18 years of age or over, that I have read and understood every clause of this Indemnity and Waiver, that I sign it freely, and that it binds me, my heirs, executors and assigns; where I sign on behalf of a corporate team I warrant my authority to bind each listed crew member.

Before You Start

Scrutineering

Saturday 5 September, 09:00–16:00 at the Service Park, Mama Ngina Waterfront. Vehicle ID, safety equipment, mechanical safety and livery placement all checked.

Shakedown

Mandatory loop on Saturday 26 September, 10:00–12:00: Mapembeni → Mama Ngina Waterfront. Must be completed before the Final Drivers Briefing.

Fuel Regulations

Supplied by the event promoter at a designated fuel zone. Unleaded petrol / standard diesel only — modifications require written Chief Scrutineer approval.
